Terms of Service
These Terms of Service ("Terms") govern your access to and use of the MaxiCyber platform and services operated by Maximum Group Digital (Pty) Ltd ("MaxiCyber", "we", "us", "our"). By creating an account or using our services, you agree to these Terms.

1. Acceptance of Terms
By accessing or using the MaxiCyber website at maxicyber.co.za, its subdomains, or any associated services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are using our services on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you must immediately stop using our services.
2. Description of Services
MaxiCyber provides cybersecurity services for South African businesses, including:
- External vulnerability scanning and assessment reports.
- Autonomous threat detection and response (ACIS platform).
- Deception technology (BaitHive Decoy, TCP Mirage).
- DNS-layer security (ShenDNS).
- Network analytics (ASPEN).
- Major Incident Response Team (MIRT) activation.
Free vulnerability scans are provided as a lead-generation service and delivered on a reasonable-effort basis. Paid subscription services are subject to their respective service level agreements.
3. Acceptable Use
You agree to use MaxiCyber services only for lawful purposes. You must not:
- Submit a domain name for scanning that you do not own or have explicit authorisation to scan. Unauthorised scanning of third-party systems may constitute a criminal offence under the Cybercrimes Act 19 of 2020.
- Use our platform to probe, attack, or compromise systems that are not under your direct control.
- Attempt to reverse-engineer, decompile, or circumvent any aspect of the MaxiCyber platform.
- Resell or redistribute MaxiCyber reports or scan data without our prior written consent.
- Use automated scripts or bots to access our services outside of our published API.
- Engage in any activity that interferes with the integrity or availability of our infrastructure.
By submitting a domain for scanning, you represent and warrant that you own or have the right to authorise the security assessment of that domain.
4. Your Obligations
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Ensuring that any information you provide to MaxiCyber is accurate and complete.
- Promptly notifying us at info@maximumgroupdigital.co.za if you suspect unauthorised access to your account.
5. Subscriptions & Billing
Paid plans (Cyber Professional and Cyber Enterprise) are billed monthly in South African Rand (ZAR) via PayFast recurring subscriptions. Subscription fees are inclusive of VAT at the prevailing South African rate.
Billing occurs on the same day each month from the date of first payment. If a payment fails, we will notify you and attempt to retry. Persistent payment failure may result in suspension of paid services.
We reserve the right to change subscription pricing with 30 days' notice to registered users.
6. Cancellation & Refunds
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.
We do not offer prorated refunds for partial billing periods. If you believe a charge was made in error, contact us within 14 days at info@maximumgroupdigital.co.za.
7. Intellectual Property
All intellectual property in the MaxiCyber platform — including but not limited to US Patent 12,284,211 B2, software code, algorithms, documentation, and brand assets — remains the exclusive property of Maximum Group Digital (Pty) Ltd or its licensors.
Your vulnerability scan reports are produced for your use only. You may share them internally within your organisation and with your professional advisors. You may not publish, sell, or sub-license them.
8. Limitation of Liability
To the maximum extent permitted by South African law, MaxiCyber shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees you paid to MaxiCyber in the 3 months preceding the claim.
Vulnerability scan reports reflect the state of your external infrastructure at the time of the scan. We make no guarantee that your systems are free from vulnerabilities not identified in our report.
9. Warranties
MaxiCyber provides its services on an "as-is" and "as-available" basis. While we strive for accuracy in all scan reports, we do not warrant that the services will be error-free, uninterrupted, or suitable for any particular security compliance requirement.
Vulnerability scan results should be reviewed by a qualified security professional before any remediation work is undertaken. MaxiCyber accepts no liability for remediation actions taken based solely on our reports.
10. Termination
We may suspend or terminate your access to any or all services immediately, without notice, if we determine that you have violated these Terms, engaged in fraudulent conduct, or posed a security risk to our platform or other users.
On termination, your right to use MaxiCyber services ceases. Sections 7 (IP), 8 (Liability), 9 (Warranties), and 11 (Governing Law) survive termination.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
Where applicable, the Electronic Communications and Transactions Act 25 of 2002 (ECTA), Consumer Protection Act 68 of 2008 (CPA), and Cybercrimes Act 19 of 2020 apply.
